These general terms and conditions are agreed between TUBESCA COMABI, a simplified joint-stock company (SAS) with a share capital of 6,393,200 euros, registered with the Bourg-en-Bresse Trade and Companies Register under number 422 481 838, hereinafter referred to as ‘TUBESCA COMABI’, and the persons browsing the website https://www.tubesca-comabi.com, hereinafter referred to as the “Website”, hereinafter referred to as the “Users”, TUBESCA COMABI and the Users being hereinafter referred to as the “Party(ies)”.
Users are professionals, a ‘professional’ being defined as ‘any natural or legal person, whether public or private, acting for purposes falling within the scope of their commercial, industrial, craftsman, professional or agricultural activity, including where they act in the name of or on behalf of another professional’.
1.2. The purpose of the Website is:
— to showcase the manufacturer’s ranges of products, providing in-depth content
— to enable users to create their own personal account and access certain features: a dedicated sales contact, certificates, e-learning, etc.
— to have a directory of partner retailers (store locator) selling the manufacturer’s products
— to offer a loyalty scheme to eligible users
— to set up an editorial blog aimed at its various audiences: industry professionals, building work professionals, retailers, renters, communities and associations, as well as private individuals.
— to provide an AI-powered smart chat service
— to enable claims to be submitted and tracked via a dedicated contact form
TUBESCA COMABI provides telephone support on +33 (0)4 74 00 90 90, available Monday to Friday from 8.30 am to 12 noon and from 2 pm to 5.30 pm. Users may also contact TUBESCA COMABI via the contact form or by email at [email protected].
1.3. These terms and conditions set out the terms governing users’ use of the Website and its features. By browsing the Website, user indicate their full and unreserved acceptance of the rules set out below.
These general terms and conditions supersede and replace the previously applicable terms and conditions. TUBESCA COMABI reserves the right to amend them at any time. The applicable terms and conditions are those in force on the day the Website is accessed.
Should any provision of these terms and conditions be held to be invalid, this shall not affect the validity of the terms and conditions as a whole.
Article 2 — Creating a user account
2.1. To access the various features of the Website, the user must log in to their personal account or create one.
When creating their account, the user undertakes to provide complete and accurate information and to update it should any changes occur. The user is responsible for the information provided during registration. TUBESCA COMABI shall not be held liable for any malfunctions caused by a user’s error.
2.2. The user is solely responsible for their username and password. In the event of loss or theft, the user must follow the password recovery procedure provided on the Website. Any access to the Website made via a user’s personal account shall be deemed to have been made by that user.
2.3. The user is solely responsible for their username and password, and undertakes to keep them confidential and not to disclose them in any form whatsoever.

3.1 Presentation of the product range
The website showcases the manufacturer’s range of access and height working products. TUBESCA COMABI endeavours to ensure that the information published on this Website is accurate and up to date, and reserves the right to amend it at any time without prior notice.
The user wishing to purchase products featured on the Website are invited to consult the online catalogue or to contact TUBESCA COMABI via the contact form to find out about the applicable terms and conditions.
3.2 Store Locator — Retailer directory
The website contains a directory of partner retailers offering products manufactured by TUBESCA COMABI. The user is informed that their details are not automatically passed on to retailers. It is up to the user to contact one of the listed retailers to arrange an appointment or obtain a quote.
The geolocation feature, which displays nearby retailers, is only enabled with your prior consent. This data is stored in a cookie placed by the widget for a maximum of one week, unless manually deleted by the user; it is not retained by the service provider Click2Buy beyond its immediate use for displaying distributors.
3.3 Contact form and tracking of enquiries
TUBESCA COMABI provides the user with a contact form enabling them to ask questions about its products and services, request quotations and lodge a complaint. You can track your claims via the customer portal. The procedures for handling disputes are set out in the Dispute Management Policy.
3.4 Blog
The website features an editorial blog aimed at users and industry professionals. The content published is provided for information purposes only and does not constitute technical or commercial advice. TUBESCA COMABI reserves the right to moderate or remove any inappropriate content.
3.5 FAQs
The website’s FAQs provide answers to frequently asked questions about TUBESCA COMABI’s products and services. These answers are provided for information purposes only and do not constitute a contractual commitment.
3.6 Intelligent Chat (AI)
TUBESCA COMABI offers an AI-powered chat service, driven by the Algolia Agent Studio solution, designed to answer users’ questions. The answers provided via the chat function are for information purposes only and do not constitute a contractual commitment on the part of TUBESCA COMABI. The user can ask to be put through to a human adviser at any time by typing ‘adviser’ into the chat. Data exchanged via the chat function is retained for 90 days, in accordance with the Website’s Privacy Policy.
Article 4 — Access to the website and use of its features

The user is responsible for their own use of the Website. The user is required to browse the Website in accordance with its intended purpose and in compliance with these terms and conditions, without infringing public order, public decency or the straight of third parties. The user is solely responsible for setting up the IT resources required to access the Website.
The User shall refrain from: accessing the Website by any means other than those made available by TUBESCA COMABI; sharing their login details with a third party; disrupting, slowing down or blocking access to networks; testing the Website’s vulnerability or breaching safety measures.
4.2. Given that the Website is provided free of charge, the User acknowledges that the Website is provided ‘as is’, without any guarantee as to its suitability, availability or performance. TUBESCA COMABI will endeavour to ensure that its functionalities are available 24 hours a day, 7 days a week, except in the event of force majeure, maintenance or a breakdown.
The User acknowledges that the speed at which information is transmitted does not depend on TUBESCA COMABI but on the inherent characteristics of electronic communications networks.
4.3. The Website is made available to the user free of charge and for an indefinite period. TUBESCA COMABI reserves the right to amend the features of the Website, to suspend access or to terminate access to all or part of the features automatically in the event of a breach of the Terms of Use, without prior notice or compensation.
Article 5 — Liability
5.1. As TUBESCA COMABI is not involved in the relationship between users and partner retailers, it accepts no liability in respect of any contract that may be entered into between them. TUBESCA COMABI cannot be held liable for any claims relating to products sold by a partner retailer.
5.2. TUBESCA COMABI shall not be held liable if any failure to perform or any damage results from the user's misuse of the Website, from the fault of a third party, or from a case of force majeure.
5.3. TUBESCA COMABI shall not be held liable for any damage caused to the User’s terminal or for any loss or damage suffered as a result of accessing or browsing the Website.
5.4. As data transmission via the Internet may be subject to errors, TUBESCA COMABI cannot be held liable for the availability of the on-line service.
5.5. The Website may contain hyperlinks to other websites. TUBESCA COMABI does not monitor their content and cannot be held liable for any damage resulting from their use.
5.6. Compensation applies only to direct, personal and certain damages. In any event, TUBESCA COMABI accepts no liability for: damage resulting from a breach of the Terms of Use; malfunctions attributable to the User’s equipment; or malicious acts by third parties.
Article 6 — Protection of personal data and cookies
6.1. TUBESCA COMABI collects and processes the personal data of users who choose to create an account or fill in the contact form. The provisions relating to this data are set out in the Website’s Privacy Policy, which the user is advised to read carefully. TUBESCA COMABI collects and processes data in accordance with current regulation and the recommendations of the CNIL.

Article 7 — Intellectual property
All content on the Website is the property of TUBESCA COMABI or is used with the permission of the rights holders. Users acknowledge TUBESCA COMABI’s exclusive rights (trademarks, logos, copyright) and undertake not to make any use of them without express prior authorisation.
Any reproduction, in whole or in part, of the Website, as well as the creation of hyperlinks, is prohibited without the express prior authorisation of TUBESCA COMABI.
Article 8 — Disputes
8.1. These Terms and Conditions are governed by French law.
8.2. The Parties shall endeavour to resolve any disputes relating to these Terms and Conditions amicably. Failing that, any dispute shall be brought before the court in Bourg-en-Bresse, to which jurisdiction is expressly conferred, even in the event of a guarantee claim or where there are multiple defendants.
